1. Who we are
Maskotto is operated by Les Artisans du Digital, a simplified joint-stock company (SAS), registered with the Paris Trade and Companies Register under number 952 778 041, with its registered office at 25 rue de Ponthieu, 75008 Paris, France. Contact: bonjour@maskotto.com.
Maskotto is available on the web and on iOS and Android apps (together, the "Service").
2. Purpose
These terms set the rules for using the Service. Purchases of credits and subscriptions are governed by our Terms of Sale. How we handle your data is explained in our Privacy Policy.
By creating an account, you accept these terms. If you do not accept them, do not use the Service.
3. What Maskotto does
- You create an AI character from a photo (of yourself, of another adult with their consent, of your pet, an object, a drawing or a style inspiration) or from a written idea.
- You generate short videos featuring this character.
- With "motion transfer", you upload a reference video: a video of yourself, or a video you hold the rights to. Your character reproduces its moves (section 6).
Generations use credits. Images and videos are produced by artificial intelligence models provided by third-party providers (see the Privacy Policy).
4. Your account
- The Service is only for people aged 18 or over.
- You provide accurate information and keep your login details confidential.
- Your account is personal. You may not transfer or share it.
- You are responsible for everything done through your account.
- You can delete your account at any time from the app settings.
5. Face photos
Your photos. You may upload: a photo of yourself (18 or over); a photo of another adult, only with their written consent; a photo of your pet, an object, a drawing or an inspiration image you hold the rights to. Not allowed: celebrities and public figures, minors, protected characters and brands (cartoons, superheroes, logos…). An "inspiration" image is only used to borrow a style, outfit or vibe: a real person's face is never copied. Your photos are only used to create your character; we never use them to identify anyone or for facial recognition. Each consent is recorded with its date.
6. Reference videos
For motion transfer, you upload a reference video of 4 to 12 seconds: a video of yourself, or a video you hold the rights to (a trend you want to remake, a friend who agreed). Your character reproduces its moves.
Your guarantee. Before each upload, you tick a box by which you guarantee that:
- you are the person filmed, or you have the written consent of every person filmed;
- everyone filmed is an adult;
- you hold the rights to the video, or you have the written consent of its author (the person who filmed or published it);
- the video contains no prohibited content (section 7).
This guarantee is recorded with its date and attached to the video concerned. It is kept for the period stated in the Privacy Policy, so that we can respond to a claim.
What the Service does. Only the moves (posture, gestures, rhythm, framing) are transferred to a synthetic character. The face and voice of the people filmed are neither reproduced nor imitated, and we perform no facial recognition. Before generation, three frames of the video go through the automated check described in section 8 (minors, nudity, weapons, celebrities, etc.); this check covers prohibited content, not your rights, which we cannot verify.
Your responsibility. You are solely responsible for the videos you upload and for how you use the result, towards the people filmed, the authors and third parties. A false guarantee leads to account suspension (section 14), and you indemnify us against any claim (section 13).
Our role. For the videos you upload, Maskotto acts as a hosting provider: we do not select these videos and cannot verify their rights. We promptly remove any video or generation reported as illegal or contrary to these terms, and we may suspend the account concerned. Report content with the "Report" button or at bonjour@maskotto.com (section 9).
Prohibited. In particular, you may not upload a video showing a minor; a celebrity or public figure; a person who has not given their consent; sexual, violent or hateful content; or a protected work (choreography, music video, film clip, music) without the necessary rights. The full list is in section 7.
7. Prohibited content
You may not create, upload or generate, directly or indirectly:
- the image or likeness of a real person without their consent, including celebrities and public figures;
- any minor, or any character that looks like a minor;
- sexual, erotic or nude content;
- violence, gore, self-harm;
- weapons, drugs or illegal activities;
- hateful, discriminatory or harassing words or symbols;
- third-party brands, logos or products;
- copyrighted works (characters, films, music…) without permission;
- misleading content meant to make people believe a real person said or did something ("deepfakes"), disinformation or scams.
You also may not bypass moderation, automate access to the Service, resell credits or disrupt the Service.
8. Moderation
Every request is checked before generation: keyword filters and an AI check. A non-compliant request is refused. If a generation is blocked, credits are not charged, or are refunded automatically.
We may also remove content already generated if it is illegal or breaches these terms.
Strikes. Each attempt to create prohibited content may lead to a strike. After three strikes, the account is frozen. In serious cases (minors, non-consensual sexual content of a real person, etc.), the account may be closed immediately and reported to the authorities.
Reasons and appeals. Each decision (refusal, removal, strike, freeze) is notified to you with its reason. You can challenge it within 6 months by writing to bonjour@maskotto.com. A human reviews your appeal. You may also use a certified out-of-court dispute settlement body or go to court.
Automated moderation is not perfect. You remain responsible for what you generate and publish.
9. Reporting content
Each piece of content has a "Report" button. You can also write to bonjour@maskotto.com stating: the content concerned, the reason for the report, and your contact details. We handle reports promptly and tell the reporter what action was taken.
10. AI transparency: label your videos
Maskotto videos are AI-generated. When you publish them (TikTok, Instagram, YouTube…), you must clearly state that they are AI-generated, for example using the platform's "AI-generated" label. Do not remove any marks or watermarks we may add.
Never present a video as real. This rule stems in particular from the EU Artificial Intelligence Act (AI Act, Article 50).
11. Ownership and rights
Your content. You keep the rights to what you upload (photos, videos, text). You grant us a free, non-exclusive, worldwide licence limited to what is needed to run the Service (storage, transmission to AI providers, generation, display in your account), for the applicable retention period.
Your generations. To the extent permitted by law and by our providers' terms, we assign to you any rights we may hold in the generated videos. You may use them, including commercially, in line with these terms. Note: AI-created content may not be protected by copyright, and a similar output may be generated for another user.
Training. We do not use your photos and videos to train AI models. Our AI providers process this data to run each generation, under their commercial terms.
Maskotto. The name, logo, website, apps and their content belong to us. Any unauthorised reproduction is prohibited.
12. Availability
We do our best to keep the Service running. It may be interrupted for maintenance, updates or a provider outage. Features and available AI models may change.
13. Liability
- You are responsible for the content you upload, generate and publish, and for how you use it.
- You indemnify us against any third-party claim related to your content or to a breach of these terms.
- We are only liable for proven fault, for direct and foreseeable damage. Nothing in these terms limits your consumer rights or our liability for gross negligence or personal injury.
14. Suspension and account closure
We may suspend or close an account for breach of these terms, fraud, or at the request of an authority. Except in urgent or serious cases, we notify you first and you can respond.
If an account is closed for a serious breach, remaining credits are not refunded, unless the law provides otherwise. If an account is closed through no fault of yours, paid and unused credits are refunded pro rata.
15. Personal data and cookies
See our Privacy Policy. By default, we only use strictly necessary cookies and trackers.
16. Changes to these terms
We may change these terms. For significant changes, we notify you at least 30 days in advance, by email or in the app. If you refuse the new terms, you can delete your account before they take effect.
17. Governing law and disputes
These terms are governed by French law. If you live in another EU country, you keep the protection of the mandatory rules of your country.
If there is a problem, contact bonjour@maskotto.com first. You can then use, free of charge, the consumer mediator listed in the legal notice. Failing agreement, the competent court is the one designated by law.
